terms and conditions
this is draft wording so the product can be used and discussed. it is not legal advice. a solicitor should adapt it to the operating company, the countries you serve, and the payment provider you appoint.
1. who these terms cover
these terms are between you and the operator of muzobook (the platform). they cover accounts, memberships, the booking fee, featuring, and use of the site. they are not the contract for a performance. that contract, if you make one, is between the artist and the booker.
2. what the platform is
muzobook lets musicians publish profiles and lets bookers search, message, post open calls, and record that a booking has been agreed. we introduce the parties. we do not employ artists, promote the event as principal, or supply the performance.
3. accounts
you must give accurate information and keep your login private. an account is either an artist (solo or band) or a booker (venue, promoter, or a person booking a private event). you must be able to enter a contract in your country. do not create an account for anyone else without their authority.
4. artist membership
listing costs £20 a year, charged in gbp. while the membership is inactive, or the profile is incomplete, the act is hidden from search and cannot receive bookings or apply to gigs. the fee pays for the listing. it is not a deposit on any show and it is not a commission.
5. the booking fee
when terms are marked agreed, the booker may pay a £10 confirmation fee in gbp. that fee is for the introduction and the record of the booking. it does not pay the artist for performing. the performance fee, whether a fixed sum, a ticket split, or both, is agreed and paid directly between the artist and the booker.
6. featured placement
artists may buy a homepage placement for £25 a week, or a category boost for £10 a week. homepage placements appear on the front page and rank above acts that have not paid. a category boost ranks higher when someone filters to that genre. placement ends when the weeks run out. it does not promise enquiries or bookings.
7. messages and profiles
do not post unlawful, misleading, or abusive content. you are responsible for your rider, prices, samples, and claims about who you are. do not upload material you do not have rights to use.
8. cancellations
either party may mark a platform booking cancelled. if the £10 fee has already been paid, it is not refunded automatically. travel, deposits, and the performance fee are outside these terms and should be agreed by the parties. we may suspend an account that misuses the site.
9. liability
to the extent the law allows, muzobook is not liable for the quality of a performance, a cancellation, a no-show, a technical failure, an injury, a loss of profit, or a dispute between users. nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.
10. disputes
a dispute about a performance or the contract to perform is between the artist and the booker. it is governed by the prevailing legal system of the place where that contract is made or the performance takes place, as applicable. these platform terms (membership, booking fee, and featuring) are a separate contract. until a solicitor confirms otherwise, they are intended to be governed by the laws of england and wales, and the courts of england and wales, without affecting mandatory rights you have in your country of residence.
11. changes and contact
we may update these terms by posting a new version. continued use after the update is acceptance of the platform terms. questions: legal@muzobook.example — replace this address with the operating company’s real contact before launch.
